Regulatory Disclosures and Limitations

Read this before you rely on anything Corvant shows you. It is written plainly on purpose. Where it conflicts with marketing copy anywhere on this site, this page and the Terms of Service govern.

1. What Corvant is, and is not

Corvant is software. It is operated by Imperium Sky Ventures Inc.

Corvant is not a customs broker. It does not hold a customs broker license, does not transact customs business on your behalf, and does not file with U.S. Customs and Border Protection.

Corvant is not a law firm and does not provide legal advice. Nothing on this site or in the platform is legal, customs, tax, accounting or financial advice, and no attorney-client relationship is created by using it.

Corvant is not affiliated with, endorsed by, or acting on behalf of U.S. Customs and Border Protection, the Department of Homeland Security, the Department of the Treasury, the U.S. International Trade Commission, the U.S. Court of International Trade, or any other federal, state or local government agency. We are a private software company. "CAPE", "ACE", "ES-003" and "ES-701" are CBP programs, systems and reports. We reference them because our customers work with them. We do not operate them, we have no special access to them, and we have no influence over how they behave.

2. Who files, and who is responsible

CBP accepts a CAPE declaration from the importer of record, or from the customs broker who filed the entry, and from nobody else.

Corvant prepares and validates declarations. You file them. The party who files is the party legally responsible for what is filed, including its accuracy and completeness. A licensed customs broker's obligations under 19 CFR Part 111 remain the broker's obligations. They are not transferred to a software vendor by using software, and we do not represent otherwise.

You are responsible for reviewing any output before you file it. Corvant is a tool used by a professional, not a substitute for the professional's judgment.

3. No guarantee of any outcome

Corvant does not guarantee:

  • that any claim will be accepted by CBP;
  • that any refund will be issued, or issued in any particular amount;
  • that any refund will be issued within any particular time;
  • that any deadline calculation is the operative deadline for your entry;
  • that any entry is eligible, or will remain eligible;
  • that any law firm will accept any matter, or that any class will be certified.

Estimates, projections and recoverable figures shown in the platform are estimates computed from the data you provide, using our understanding of the rules as they stand on the date shown. They are not a promise of payment and are not a professional opinion. Every such figure is subject to: CBP's own review and determination; the law, regulations and court rulings as they stand when your claim is decided; the accuracy and completeness of the data you gave us; and the particular circumstances of your entries. Acceptance of a declaration is not a refund: CBP states that refunds follow acceptance by 60 to 90 days, and that period is outside our control.

4. Errors, and the fact that they happen

Software contains errors. So do data files, so do government systems, and so do we.

We build Corvant to be correct and we correct what we find. We do not represent that the platform is error-free, uninterrupted, or that every calculation, classification, deadline, validation result or flag is accurate in every case. Specifically, and without limiting the general statement:

  • Source data. Computations run on the files you upload. An ES-003 missing columns, carrying stale liquidation data, or exported with different settings produces different answers. We validate what we can see; we cannot validate what is not in the file.
  • Deadlines. Statutory windows are computed from liquidation dates in your data. Where a date is absent, we say so rather than inventing one. Where CBP has suspended, extended or otherwise altered an entry's status, our view may lag CBP's. Verify every operative deadline against your own records and CBP's own notices before you rely on it.
  • Validation. Pre-validation checks against the rules as we understand them. Passing validation is not a prediction that CBP will accept a declaration, and a flag is not a prediction that CBP will reject one.
  • Government systems. CAPE, ACE and the CBP systems around them can be unavailable, can change without notice, can change behavior between releases, and can reject a submission for reasons we could not anticipate. A CAPE submission may be returned in whole for a single error. We have no ability to prevent, predict or appeal that.
  • Rules change. Tariff authorities, court decisions and CBP guidance change, sometimes retroactively. Content dated on this site reflects our understanding on the date shown and may be superseded.
  • Third parties. We depend on infrastructure, payment, email and storage providers. Their failures can interrupt the service.

If something we produced is wrong and you notice it, tell us. We would rather hear it early.

5. Court rulings and clawback notices

Court events recorded in the platform are recorded by the Corvant team and maintained daily. They are not a live feed of the courts, are not comprehensive, and may lag or omit a decision.

Where we match a recorded ruling's scope against lines in your account and report exposure, that is an informational calculation based on the scope as we recorded it. It is not legal advice about that ruling, not a prediction of what CBP or any court will do, and not a substitute for advice from your own counsel. The absence of a notice does not mean you are not exposed.

6. Money

CBP pays CAPE refunds by ACH directly to the importer of record. Corvant does not receive, hold, disburse or advance refund money, and is never in the money path.

Fees payable to Corvant are set out in your agreement with us and are presented before you incur them. On the broker side, Corvant charges a flat amount per line filed and takes no percentage of a broker's fee to a client and no percentage of a refund, consistent with 19 CFR 111.36. What a customs broker charges an importer is a matter between them.

7. Your records

Files you upload are encrypted at rest using AES-256 server-side encryption provided by Amazon S3.

You remain responsible for your own recordkeeping obligations, including the five-year record retention requirement under 19 CFR Part 163. Corvant's retention of your data is described in your agreement and in our Privacy Policy, and you should not treat the platform as your system of record for regulatory purposes.

8. Published agreements

Fee terms and any authorization you are asked to sign are published for your own counsel to review before signature, not produced at the point of signing.

9. Fraud warning

CBP has publicly warned about tariff-refund schemes. That warning is appropriate and we repeat it.

Before you engage anyone for this work -- including us -- ask three questions: who files, who touches the refund, and what do you take. If the answers are unclear, unwritten, or involve a party who never touched your entries taking a share of your money before a refund exists, stop.

9A. Figures, aggregates and examples

Aggregate market figures on this site -- the size of the refund pool, the number of importers affected, amounts accepted into CAPE -- are drawn from CBP's own reporting and filings and are dated where shown. They describe an industry, not you, and say nothing about what your entries are worth.

Screens shown on this site are product mockups with illustrative data, marked as such. No figure in a mockup is a real customer's, and none is an example of what you should expect.

We publish no testimonials, case studies or customer results at present. If we ever do, each will be an individual experience, will not be typical, and will not be a representation of what you will achieve. Any material connection between us and a person endorsing us will be disclosed.

Links from this site to other organizations are for convenience. We do not control them, do not endorse them, and are not responsible for their content, their products or their handling of your data.

10. Limitation of liability

Your use of Corvant is governed by our Terms of Service, which include limitations of liability and disclaimers of warranty. Nothing on this page expands any warranty or any obligation beyond what those Terms provide, and to the extent this page and the Terms conflict, the Terms govern.
