What CBP makes hard
The refund is real. The process is unforgiving.
The money is owed to you. Getting it out of CBP is a different problem — three places a claim quietly dies before anyone notices.
Only one party can file
CBP accepts a CAPE declaration only from the original filer — you as importer of record, or the broker who filed your entries. A third party who never touched the entry gets rejected. Pick the wrong filer and the claim doesn't move.
The refund can bounce silently
Refund banking has to be authorized before the declaration goes in. Skip it and CBP can accept the filing while the money never arrives — no error, no flag, just a refund that quietly fails to land.
The window is short
Phase 1 covers entries that are unliquidated or within 90 days of liquidation. Miss it and the claim drops to the slower protest track. Knowing which of your entries sits where decides what's still recoverable.
