DRAFT FOR COUNSEL REVIEW. Written by Corvant against the platform as built. Not effective until counsel has reviewed it and the effective date is confirmed.

This policy forms part of the Terms of Service. Where the two conflict, the Terms govern.

1. Why this exists

Corvant handles customs entry data and produces declarations that a customs broker or an importer of record then files with U.S. Customs and Border Protection. Misuse of the platform is not a private matter between us. It can put a licensed broker's license at risk, expose an importer to penalties, and in some cases constitute a federal offense.

2. Who may use the platform

You may use Corvant if:

  • you are an importer of record, or a person authorized to act for one;
  • you are a licensed customs broker, or a person employed by or authorized by a licensed customs brokerage;
  • you are a law firm, a finance provider or a referral partner working under an agreement with us; or
  • you have otherwise been granted access by us in writing.

You must be at least 18 and able to enter a binding contract. The platform is for business use. It is not directed at consumers or at children.

3. Permitted use

Use the platform to work with entry data you have a legitimate right to handle, to compute what may be refundable, to prepare and validate declarations, and to manage the resulting work.

4. Document and data integrity

This section is the heart of this policy.

You must not:

  • upload a document or data file that has been altered, fabricated, or edited to misstate what was entered with CBP;
  • change an entry number, a liquidation date, an entered value, a tariff classification, a country of origin or any other field in order to make an entry appear eligible when it is not;
  • submit data for entries you did not file and are not the importer of record for, and are not authorized to act on;
  • claim an amount you know is not refundable, or knowingly conceal a trade-preference claim, a suspension, an extension, or any other fact that affects eligibility;
  • use the platform to prepare a declaration you intend to submit under a filer identity that is not yours and not one you are authorized to use; or
  • represent output from Corvant as having been reviewed, approved or accepted by CBP, or as having been produced by a customs broker or an attorney, when it has not.

You are responsible for reviewing any output before it is filed. Corvant's validation checks what it can see in the data you provide. It cannot detect that a file has been altered.

5. Accounts, access and other people's records

  • Keep your credentials confidential, use two-factor authentication where offered, and tell us promptly if you suspect an account has been compromised.
  • One account per organization. Do not share a single login among people who should each have their own.
  • Do not access another organization's records, or attempt to. Connections between a customs broker and an importer exist only where both sides have consented, and a broker's obligations regarding client records, including under 19 CFR 111.24, remain the broker's own.
  • If someone leaves your organization, remove their access.

6. Prohibited activities

You must not:

  • break the law, or use the platform to help someone else break it;
  • infringe anyone's intellectual property or confidentiality rights;
  • upload malware, or anything designed to disrupt or gain unauthorized access;
  • probe, scan, penetration-test or attempt to circumvent any security or access control without our prior written permission;
  • scrape, crawl, or use automated means to extract data at scale, or resell or redistribute platform data or output except as your agreement allows;
  • reverse engineer the platform, or use it to build a competing product;
  • impose an unreasonable load on the service, or interfere with anyone else's use of it;
  • misrepresent your identity, your authority, or your relationship to an importer or a broker; or
  • use the platform to solicit business in a way that violates any law governing your profession.

7. Communications

Do not use the platform to send unsolicited commercial messages, or to harass, threaten or abuse anyone, including our staff.

8. Monitoring and enforcement

We do not routinely review your data and we do not want to. We do keep operational and security logs, and we may investigate where we have reason to believe this policy has been breached or where we are required to.

Where we find a breach we may warn you, restrict or suspend access, terminate your account, or take any other step available to us. Where conduct appears to involve fraud on the United States or another serious offense, we may be required to report it, and we may do so without notice to you.

Suspension or termination does not entitle you to a refund of line credits or fees already paid. Line credits are not refundable.

9. Reporting a problem

If you believe someone is misusing the platform, or you find a security vulnerability, write to legal@corvant.io. Report vulnerabilities to us before disclosing them publicly, and do not access other people's data while investigating.

10. Changes

We may update this policy. Material changes will be notified through the platform or by email, and the date above will change.
